- Other legislative and regulatory acts of Ukraine
1. GENERAL PROVISIONS
1.1. This User Agreement (hereinafter – the "Agreement") is a public offer agreement in accordance with Art. 633, 641 of the Civil Code of Ukraine and defines the terms of use of the website https://masterpech.com.ua/ (hereinafter – the "Site"), which is owned and administered by FOP Kobzar Roman Stanislavovych (online store "Masterskaya Pechnikov", hereinafter – the "Site Administration" or the "Seller").
1.1.1. This Agreement is also regulated by the requirements of the Law of Ukraine "On Electronic Commerce" dated 03.09.2015 No. 675-VIII regarding the establishment of rules for interaction in the field of e-commerce and the conclusion of electronic transactions.
1.2. The use of this Site, including browsing pages, registration, and filling out feedback forms, constitutes the User's full and unconditional acceptance of the terms of this Agreement.
1.3. If the User does not agree with the terms of this Agreement, they must immediately cease using the Site.
1.4. This Agreement may be amended by the Administration unilaterally without prior notice to the Users. The Administration shall notify of significant changes that worsen the position of Users at least 30 days before the changes take effect by publishing a notice on the Site and sending information to the email addresses of registered users (if available). The changes come into force from the moment of their publication on the Site.
1.5. This Agreement applies to all types of electronic transactions concluded through the Site, including the purchase of goods, ordering of services, and other types of commercial interactions.
2. DEFINITIONS OF TERMS
2.1. Site – an internet resource located at the address https://masterpech.com.ua/, including all its pages, sub-sections, and services.
2.2. User – any natural or legal person using the Site.
2.3. Site Administration – FOP Kobzar Roman Stanislavovych (online store "Masterskaya Pechnikov"), which manages and maintains the Site.
2.4. Content – any information posted on the Site: texts, images, video materials, program code, design, trademarks, and other intellectual property objects.
2.5. Personal Data – any information relating to an identified or identifiable natural person.
2.6. Electronic Commerce – relations aimed at making a profit, which arise when concluding transactions regarding the acquisition, modification, or termination of civil rights and obligations, carried out remotely using information and telecommunication systems.
2.7. Electronic Transaction – a transaction made using information and telecommunication systems.
2.8. Online Store – a website or its section through which the presentation or sale of goods, works, or services is carried out by means of electronic transactions.
3. TERMS OF SITE USE
3.1. The Site is intended to provide information about the goods and services of the Administration, as well as to enable the conclusion of sales agreements in accordance with the Public Offer and the requirements of the Law of Ukraine "On Electronic Commerce".
3.2. The User has the right to:
- view the information posted on the Site;
- use the search and navigation features of the Site;
- contact the Administration through feedback forms;
- register on the Site to obtain additional features;
- make electronic transactions in accordance with the terms of the Site and legal requirements;
- receive electronic documents confirming the conclusion of transactions;
- enjoy all the rights provided for consumers in distance purchases.
3.3. The User undertakes to:
- use the Site only for lawful purposes;
- not to disrupt the functionality of the Site;
- not to take actions aimed at unauthorized access to the Site;
- provide accurate information during registration and order placement;
- comply with the requirements of the legislation of Ukraine when making electronic transactions;
- not to use the Site for fraudulent or other illegal activities.
4. USAGE RESTRICTIONS
4.1. The User is PROHIBITED from:
- copying, modifying, or distributing the Site's content without the written consent of the Administration;
- using the Site to transmit viruses, spam, or malicious code;
- posting illegal, offensive, or third-party rights-infringing information on the Site;
- performing actions that could damage the reputation or interests of the Administration;
- using automated systems to collect information from the Site without permission;
- attempting to bypass security systems or gain unauthorized access to other users' data;
- performing actions aimed at disrupting the functioning of electronic payment systems.
4.2. For violation of these restrictions, the Administration has the right to:
- block the User's access to the Site;
- delete information posted by the User;
- apply to the competent authorities to protect its rights;
- recover damages caused by the User's unlawful actions.
5. INTELLECTUAL PROPERTY AND COPYRIGHTS
5.1. All materials of the Site (texts, images, design, program code, trademarks, logos) are objects of intellectual property and are protected by the copyright laws of Ukraine.
5.2. The rights to the content of the Site belong to FOP Kobzar Roman Stanislavovych or are used on a legal basis.
5.3. The User may use the materials of the Site exclusively for personal non-commercial use. Any other use is possible only with the written permission of the Administration.
5.4. When using materials from the Site, a reference to the source is mandatory: https://masterpech.com.ua/.

6. ELECTRONIC TRANSACTIONS AND E-COMMERCE
6.1. Electronic transactions made through the Site are regulated by the Law of Ukraine "On Electronic Commerce" and have the same legal force as transactions made in writing.
6.2. To conclude an electronic transaction, the User:
- reviews the information about the product/service;
- fills out the order form, providing accurate data;
- confirms the order in the manner provided on the Site;
- receives an electronic confirmation of order acceptance.
6.3. An electronic transaction is considered concluded from the moment the Administration receives order confirmation from the User and sends a corresponding confirmation. The confirmation of the conclusion of an electronic transaction is an electronic document (electronic receipt, order confirmation, invoice) sent to the User's email address.
6.4. All electronic documents related to the transaction are stored electronically and are accessible to the User in accordance with the terms of this Agreement.
6.5. Disputes concerning electronic transactions are resolved in accordance with the current legislation of Ukraine, taking into account the specifics of electronic document flow.
7. TECHNICAL SUPPORT AND AVAILABILITY
7.1. The Administration strives to ensure the uninterrupted operation of the Site but does not guarantee the absence of technical failures, temporary unavailability, or errors.
7.2. Technical maintenance of the Site may be carried out without prior notice to Users.
7.3. For the correct operation of the Site, it is recommended to use modern browser versions with JavaScript and cookies support.

7.5. The response time to user inquiries is no more than 3 working days from the moment the inquiry is received.
8. REGISTRATION AND ACCOUNTS
8.1. Registration on the Site is not mandatory for viewing information but may be required to use additional features and make electronic transactions.
8.2. When registering, the User undertakes to provide accurate data and keep it up to date.
8.3. The User is fully responsible for the security of their registration data (login, password).
8.4. The Administration has the right to block or delete a User's account in case of violation of the terms of this Agreement.
8.5. The User has the right to delete their account at any time by contacting customer support.
8.6. Upon deletion of an account, the User's personal data is subject to deletion in accordance with the Privacy Policy.
9. PERSONAL DATA PROCESSING
9.1. The terms of personal data processing are detailed in the Privacy Policy, which is an integral part of this Agreement.
9.2. By using the Site, the User agrees to the processing of their personal data in accordance with the Privacy Policy and the Law of Ukraine "On Personal Data Protection".
9.3. The Site uses cookies to improve functionality, personalize content, and analyze traffic. Continued use of the Site constitutes consent to the use of cookies. The User can configure cookie processing in their browser settings.
9.4. The User has all the rights provided by the legislation on personal data protection, including the right to access, rectify, erase, and data portability.
9.5. The Administration ensures the protection of personal data in accordance with the requirements of Ukrainian and European legislation.
10. LIABILITY AND LIMITATIONS
10.1. The Administration is not responsible for:
- losses arising from the use or inability to use the Site;
- unlawful actions of third parties;
- technical failures in the operation of internet providers;
- viruses or malicious software that may infect the User's device;
- actions or inactions of payment systems and banks;
- violation of delivery times for reasons beyond the Administration's control.
10.2. The limitations of liability provided for in this Agreement do not apply to cases where the Administration's liability is established by mandatory provisions of the current legislation of Ukraine, including the Law "On Consumer Rights Protection".
10.3. The Administration is responsible for the accuracy of information about goods and services posted on the Site, in accordance with the current legislation of Ukraine.
10.4. The User is fully responsible for complying with the terms of this Agreement and the current legislation of Ukraine.
10.5. The total liability of the Administration to the User cannot exceed the cost of goods or services purchased by the User through the Site.
11. LINKS TO EXTERNAL RESOURCES
11.1. The Site may contain links to external resources, for the content of which the Administration is not responsible.
11.2. Following external links is done at the User's own risk.
11.3. The Administration does not control and is not responsible for the privacy policies of external sites.
11.4. Users are recommended to familiarize themselves with the terms of use of external resources before using them.
12. DISPUTE RESOLUTION AND RIGHTS PROTECTION
12.1. All disputes arising in connection with the use of the Site shall be resolved through negotiations between the parties.
12.2. Users have the right to seek protection of their rights from:
- The State Service of Ukraine on Food Safety and Consumer Protection
- The Ukrainian Parliament Commissioner for Human Rights (on matters of personal data protection)
- The National Commission for the State Regulation of Communications and Informatization
- Consumer organizations

12.4. Users also have the right to pre-trial dispute resolution through mediation procedures in accordance with the Law of Ukraine "On Mediation" or by applying to the ombudsman of the relevant sphere.
12.5. If it is impossible to resolve a dispute through negotiations, the dispute shall be subject to consideration in court at the location of the Administration in accordance with the current legislation of Ukraine.
12.6. The substantive law of Ukraine applies to the relations between the parties.
13. FINAL PROVISIONS
13.1. This Agreement is effective from the moment the User starts using the Site and until such use is terminated.
13.2. The invalidity of individual provisions of the Agreement does not entail the invalidity of its other provisions.
13.3. This Agreement is drawn up in Ukrainian and Russian. In case of translation into other languages, the Ukrainian version shall prevail in case of discrepancies.
13.4. Issues not regulated by this Agreement are governed in accordance with the current legislation of Ukraine.
13.5. This Agreement complies with the requirements of European legislation as part of the European integration process of Ukraine.
13.6. The Administration reserves the right to change the design of the Site, its content, the list of goods and services, as well as any aspects of the Site's functioning at any time without prior notice.
